Terms of Service & Legal Agreement

1. ACCEPTANCE OF TERMS

By accessing or using KiRicochoAPP ("the App", "we", "our"), you agree to be legally bound by these Terms of Service ("Terms"), our Privacy Policy, and any applicable guidelines or policies incorporated herein by reference.

These Terms apply to all users of the App, including users who download the App without creating an account ("Guest Users"), users who register an account via Google Sign-In or Apple Sign-In, and users who make purchases within the App.

If you are under 13 years of age, you are not permitted to use this App. Users between 13 and 18 years of age must have the consent of a parent or legal guardian. In-app purchases require you to be at least 18 years old or have explicit parental authorization.

2. DESCRIPTION OF SERVICE

KiRicochoAPP is an entertainment platform designed for fans of association football (soccer) in connection with the FIFA World Cup 2026. The App allows users to participate in a ritual-based fan engagement experience, which includes applying virtual "Mufa" (bad luck) or "Antimufa" (good luck) rituals to teams and players of upcoming matches.

The App also provides a "Logbook" feature that allows users to record personal memories of matches through photos, text entries, and geolocation data.

KiRicochoAPP is strictly an entertainment product. Nothing within the App constitutes sports betting, gambling, financial advice, or any real-world influence on football matches, players, teams, or outcomes.

• Ritual actions are symbolic and have no actual effect on match results.
• Player and team data displayed in the App is used for identification and entertainment purposes only.
• The App is not affiliated with, endorsed by, or connected to FIFA, any national football federation, or any football club.

3. ENTERTAINMENT DISCLAIMER — RITUALS & OUTCOMES

THIS IS THE MOST IMPORTANT CLAUSE. KiRicochoAPP is designed exclusively for entertainment. The "rituals" featured in the App — including but not limited to Mufa, Antimufa, Kiricocho, Ball, Red Card, Golden Ball, Coach, and any other in-app actions — are fictional, superstition-inspired entertainment mechanics. They carry no scientific basis and are not capable of influencing, affecting, or altering the outcome of any real-world football match, player performance, team result, or sporting event.

By using the App you explicitly acknowledge and agree that:

• You will not use the App to make or inform financial decisions, including sports wagers.
• You will not interpret any in-app scores, counters, or ritual results as predictions or factual data.
• The App does not promote gambling in any form.
• No refund will be issued based on the outcome of any football match, regardless of rituals applied.

4. USER ACCOUNTS & AUTHENTICATION

You may use the App as a Guest without creating an account. Guest usage limits certain features, including cloud synchronization of your Logbook.

You may sign in using your Google account (via Google OAuth 2.0) or your Apple ID (via Apple Sign In). By doing so, you authorize KiRicochoAPP to access your basic profile information (name, email address, and profile picture) as provided by those platforms.

You are responsible for maintaining the confidentiality of your authentication credentials and for all activity that occurs under your account. You must notify us immediately at contact@kiricochoapp.com if you become aware of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, attempt to circumvent purchase verification, or manipulate in-app counters through automated means.

5. IN-APP PURCHASES, SUBSCRIPTIONS & CREDITS

KiRicochoAPP offers optional paid features through a subscription-based plan system (Free, Basic, Premium, Cup) and purchasable packs of virtual credits ("Ritual Credits"). All purchases are processed exclusively through the Apple App Store or Google Play Store billing systems and are subject to their respective terms.

IMPORTANT — By making a purchase you understand and agree that:

• All in-app purchases are final and non-refundable, except where required by applicable law or the policies of Apple / Google.
• Ritual Credits and Pack purchases are virtual goods with no monetary value, cannot be transferred, sold, or exchanged, and will not be refunded if your account is suspended for a Terms violation.
• Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date through your App Store or Google Play account settings.
• We do not have access to your payment information. All billing is managed directly by Apple or Google.
• Price changes to subscriptions will be communicated in advance and will not apply until the next renewal period.
• If a subscription is cancelled, you retain access to paid features until the end of the paid period.
• KiRicochoAPP reserves the right to modify, discontinue, or alter features associated with any plan at any time, with prior notice where possible.

6. LOGBOOK — USER-GENERATED CONTENT

The Logbook feature allows you to create personal records ("Entries") associated with football matches. Each Entry may include a photograph taken with your camera or selected from your device gallery, a written description of up to 280 characters, tagged friend mentions, and GPS coordinates captured at the time of photo capture.

By creating Logbook Entries you grant KiRicochoAPP a non-exclusive, worldwide license to store and display that content solely for the purpose of providing the App's services to you. We do not use your Logbook content for advertising, training AI models, or any purpose other than your personal use of the App.

You are solely responsible for the content of your Logbook Entries. You must not upload content that is unlawful, harmful, obscene, harassing, defamatory, or that infringes the intellectual property rights of third parties.

Logbook Entries are synced to the cloud only if you are signed in. Guest users' Logbook data is stored locally on the device and may be lost if the app is uninstalled.

7. LOCATION DATA (GPS)

The App requests access to your device's location services exclusively for the purpose of automatically embedding GPS coordinates in your Logbook Entries. Location data is collected only at the moment you capture a photo for a Logbook Entry and is not collected in the background or when the App is not in use.

GPS coordinates are stored as part of your Logbook Entry and may be synced to our cloud servers (Supabase) if you are signed in. They are used solely to allow you to view the location of a memory on a map within the App.

You may deny location permissions without affecting your ability to use any other feature of the App. You can revoke location permissions at any time through your device settings.

8. PRIVACY & DATA PROTECTION

Your privacy is important to us. By using the App, you agree to the collection and use of your information as described in our Privacy Policy, which is incorporated into these Terms by reference.

The App collects and processes the following categories of personal data:

• Account data: Name and email address (only if you sign in via Google or Apple).
• Usage data: Ritual actions applied (associated with match and player IDs, not personal identity).
• Content data: Logbook photos, descriptions, GPS coordinates (stored only for your personal use).
• Device data: Device type and OS version (for technical support and analytics).
• Purchase data: Subscription tier and pack ownership (NOT your payment card information).

9. GDPR — EUROPEAN USERS

If you are located in the European Economic Area (EEA), Switzerland, or the United Kingdom, you have specific rights under the General Data Protection Regulation (GDPR) including the right to access, correct, or delete your personal data, the right to restrict or object to processing, and the right to data portability.

Our legal basis for processing your data is: (a) performance of the contract when you use features you have requested; (b) legitimate interests for security and fraud prevention; and (c) your explicit consent for optional features such as GPS location capture.

10. INTELLECTUAL PROPERTY

All content within KiRicochoAPP, including but not limited to the name "KiRicochoAPP", the app logo, graphic assets, sound effects, animations, ritual icon designs, visual design, and software code, is the exclusive intellectual property of KiRicochoAPP and its developers, protected by applicable copyright, trademark, and intellectual property laws.

The term "Kiricocho" references a cultural superstition from Argentine football tradition and is used within the App as a tribute to that folklore. Match schedule data (teams, dates, groups) is publicly available information from official tournament sources.

You may not copy, modify, distribute, sell, or reverse engineer any part of the App or its content without prior written permission.

11. THIRD-PARTY SERVICES

KiRicochoAPP integrates third-party services that have their own terms of service and privacy policies. Your use of the App implies acceptance of those policies where applicable:

• Supabase (supabase.com) — Backend database and authentication infrastructure.
• Google Sign-In — OAuth 2.0 authentication provided by Google LLC.
• Apple Sign In — Authentication service provided by Apple Inc.
• Google Play Billing / Apple In-App Purchase — Payment processing.
• Google Fonts — Typography assets served under the Open Font License.

12. PROHIBITED USES

You agree not to use the App in any of the following ways:

• Attempting to reverse-engineer, decompile, or extract the source code of the App.
• Using automated scripts, bots, or tools to submit ritual actions or inflate counters.
• Uploading content that is defamatory, harassing, obscene, or that infringes the rights of others.
• Circumventing purchase verification or attempting to unlock paid features without a valid purchase.
• Using the App in connection with real-money gambling or sports betting.
• Impersonating other users or creating multiple accounts to abuse the free quota system.
• Attempting to access or tamper with another user's account, data, or Logbook entries.

13. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KIRICOCHOAPP DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, free of viruses, or that defects will be corrected. We do not warrant the accuracy or completeness of any match data, schedule, or score information displayed.

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KIRICOCHOAPP AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

Our total cumulative liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid to KiRicochoAPP in the twelve (12) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

15. CHANGES TO THE TERMS

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date at the top of this document and, where appropriate, by sending an in-app notification or email.

Your continued use of the App after any modification to the Terms constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the App.

16. TERMINATION

You may stop using the App at any time. You may delete your account by contacting us at contact@kiricochoapp.com.

We reserve the right to suspend or terminate your access to the App, with or without notice, if you violate these Terms, engage in fraudulent activity, or cause harm to other users or to our systems.

Upon termination, your right to use the App ceases immediately. Sections related to intellectual property, disclaimer of warranties, limitation of liability, and governing law survive termination.

17. GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by and construed in accordance with the laws of the Argentine Republic, without regard to conflict of law principles. This choice of governing law does not override mandatory consumer protection laws applicable in your country of residence.

For users residing in the European Union: You may bring claims before the courts of your country of residence. For EU consumers, disputes may also be submitted to the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

Any dispute not resolved informally shall be submitted to the competent courts of the City of Buenos Aires, Argentina.
